Luma (Agatha Moreira) is finally taking back what’s yours in You Mania. She ate around the edges and raised R$9 million and even a restaurant during a negotiation with Mavi (Chay Suede), despite having had to give up his “dignity”, “his “truth” and his “history” —in a scene that went viral on social media. However, the entire coup plot could have been resolved a long time ago, simply by looking for a lawyer.

The process, in fact, wouldn’t even be that complicated. Gustavo Kloh, specialist in Patrimonial Law and professor at FGV Direito Rio (Rio de Janeiro Law School of Fundação Getúlio Vargas), explains that the power of attorney signed by her could have been easily canceled in the first four years.

The power of attorney is the document that Mavi convinced Luma to sign in order to have control over her assets. Of course, the preppy girl had no idea of ​​the implications of this. She only signed the paperwork because she thought it was the rental contract for an apartment for the two of them in São Paulo. But, when she realized what happened, the woman only had to go to the registry office, claim that she did not understand the document well and ask for it to be annulled.

Furthermore, there is the possibility that the power of attorney issued by the villain was not even formally accepted. “It is very difficult to create this type of power of attorney in the real world. Because, nowadays, according to the understanding of our courts, it is only possible to create a power of attorney bypassing powers to dispose of assets by listing it asset by asset. In other words: detailing it in detail this power of attorney. It cannot be generic“, explains the lawyer to TV News.

Of course, things spilled over from the moment Mavi transferred his then-wife’s assets into his own name. After all, to reverse this transaction, the character would have to file a lawsuit against him.

The action of forging a power of attorney (as in the case of Mavi, who made the chef sign the document thinking it was about another matter) or even abusing the powers granted by the document can be classified as embezzlement (Art. 171 of the Penal Code). “It’s a civil case, and the penalty can be one to five years in prison“, concludes Gustavo Kloh.

Luma, therefore, could have filed this lawsuit at any time — and can still do so. “To show that the power of attorney is fraudulent, there is no deadline. It would make more sense for her to try to annul it, but four years have already passed at the turning point, right?”, concludes the professor.

However, Justice does not seem to exist in the plot of João Emanuel Carneiro –except for the investigation into the death of Molina (Rodrigo Lombardi), which, incidentally, could result in Mavi serving 12 to 30 years in prison, given the vile motive for the crime. Meanwhile, Agatha Moreira’s character must continue to follow through tortuous path of blackmail.
