The Federal Supreme Court (STF) scheduled the resumption of the virtual habeas corpus trial filed by the defense of former football player Robinho, who has been in prison since March this year, for November 15th.

The former player’s defense intends to overturn the decision of the Superior Court of Justice (STJ) that approved the Italian court’s sentence against Robinho and ordered his immediate arrest.

He was sentenced to nine years in prison in Italy for his involvement in the rape of a woman, which took place inside a Milan nightclub in 2013.

The trial has been suspended since last month due to a request for a review made by Minister Gilmar Mendes.

So far, only the vote of the case’s rapporteur, Minister Luiz Fux, has been given. For the minister, there were no irregularities in the STJ’s decision that determined the arrest.

“The STJ, in the exercise of its constitutional competence, complied with the Constitution and Brazilian laws, the agreements signed by Brazil in matters of international cooperation and the norms that govern the matter, with special attention to the fact that the patient responded to the process duly assisted by a lawyer he trusts and has been definitively sentenced to a sentence of nine years in prison for the crime of rape”, said Fux.

Robinho is imprisoned in the Tremembé penitentiary complex, known as the “famous penitentiary”.
