Simples Nacional debts can be paid in up to 60 installments, see conditions

Legal entities registered with Simples Nacional, a program that unifies taxes and offers tax benefits, must regularize their debts or will be excluded from the taxation regime from January 1, 2025. Those who are in debt to the Union must check the pending report through of the Electronic Tax Domicile (DTE) and pay the amounts within 30 days. It is possible to pay the debt in up to 60 installments, but the minimum installment must be R$300.
Taxpayers can only pay their debts in installments with the Federal Revenue until they are sent for registration in the Union’s Active Debt. After sending, the installments must be requested from the Attorney General’s Office of the National Treasury. It is not the legal entity that chooses the desired number of installments.
Approval of the installment request depends on payment of the first installment. If the first installment is not paid by the due date, the order will not take effect and the system will allow a new request. The process is entirely digital, carried out through the Revenue website.
Three types of legal entities are accepted in Simples Nacional: individual microentrepreneurs (MEIs), microenterprises (ME) and small businesses (EPP). None of them can stay in the program if they have debt. In case of exclusion, it is possible to request re-entry into the taxation regime, always in the first month of the year. In this case, the Federal Revenue Service will only accept the entry if the taxpayer has no disputes with the Union, states or municipalities.
Debts that have already been paid in installments can be re-installed, which may include new debts. In this case, the first installment will be
10% of the total debt or 20% of the total debt, if any debt has already been paid in installments before. For more information, go to Federal Revenue website.
“The installment options depend on the type of company, but this option always exists. The first step is to see which obligations have not been fulfilled and make the pending declarations. If the debt is still at the administrative level, at the Federal Revenue, MEIs can make the installments on the Revenue website or seek assistance at the Citizen Assistance Service (SAC)”, explains Adriana Pereira, technical analyst at the Brazilian Micro and Small Business Support Service (Sebrae) in Salvador.
She remembers that Sebrae does not pay Simples Nacional debts in installments. “Micro and small companies must access the e-CAC Portal, on the Federal Revenue website, to collect debts and installment options”, he adds.
According to the Federal Revenue, Bahia has 60,209 MEIs with debts to the Union, the total value of the debt reaches R$ 173,411.09. The amount of debt owed by small companies in Bahia is R$1,109,580,591. There are 37,319 enterprises of this type in debt.
