A man was sentenced by the Bahian court to 13 years in prison for the crime of raping a vulnerable person, in Euclides da Cunha, northeast of Bahia. According to the Public Ministry of Bahia (MP-BA), he was sentenced to two years in prison for threatening and supplying alcohol to minors. The crimes took place in April 2023. The court also maintained the defendant’s preventive detention. There is still an appeal.
In the decision, dated September 23, the judge of the Criminal Court of Euclides da Cunha, João Paulo Bezerra, highlighted the vulnerability of the rape victim, who was a minor, 15 years old, and was drunk. According to the complaint, the convict met the victims, two teenagers, in a bar in the city. He offered alcoholic drinks to the minors and later invited them to his residence. There, he continued to supply alcoholic beverages to young women.
Taking advantage of the victims’ state of intoxication, the convict forced one of them into a room and had sexual intercourse with her without her consent. He also threatened the teenagers, saying that he was a police officer, that he had a gun and that he had already killed his own brother.
In her statement, the rape victim reported that she had no interest in having sexual relations with the accused and that she was drunk at the time of the crime, which was confirmed by her friend who testified to the events. The defendant confessed to having sexual relations with the victim, but claimed that she was conscious and consented to the act.
