The Federal University of Bahia published this Tuesday (29) the appointment of doctor Lorena Pinheiro Figueiredo, after the otorhinolaryngologist lost her vacancy due to a court decision and, later, won an injunction that determines the application of a new vacancy. The information was published in the Official Gazette of the Union.

The professional was qualified in a public competition approved on August 13, 2024, for the position of Adjunct Professor at the Faculty of Medicine of Bahia. The work schedule is 20 hours per week. The appointment complied with a determination from the 1st Federal Court SJBA. The Court recognized that Lorena Pinheiro was approved first among the vacancies in the competition for quota holders and, therefore, was entitled to appointment so as “to avoid losses that would be difficult to repair”.

From the date of appointment, the professor will have 30 days to take office and report to the Department of Experimental Surgery and Surgical Specialties. Lorena celebrated the decision. “It’s a big victory. Although I am very happy, I know that the decision does not correct the injustice. We still live in legal uncertainty regarding the Quota Law”, he says.

Shareholder, Lorena came in first place after the last phase – hetero-identification -, but had her result questioned by the candidate approved in the broad competition, in an action against affirmative actions. Now, the same judge who had originally denied the result, magistrate Arali Maciel Duarte, holder of the jurisdiction, granted an injunction for Ufba to appoint Lorena to the position of professor of higher education, at the Faculty of Medicine of Bahia (FMB).

“What will be the future of the application of the Quota Law in teaching competitions? There is a legal uncertainty when the candidate from broad competition takes my place. The injustice is still there, the structural differences that hinder the arrival of black people in these spaces are still there. This preliminary decision does not correct the injustice”, said Lorena, in an interview with CORREIO.

The decision was originally published on October 4th of this month. Ufba had five days to comply with it, after becoming aware, but this did not happen. Thus, on the 22nd, the magistrate issued a new order so that the decision could be complied with in two days, under penalty of a daily fine being set.

Furthermore, the sentence comes in the same week that the Federal Public Ministry (MPF) issued a favorable opinion to Lorena in the process regarding the notice. In the text, Federal Prosecutor Fábio Conrado Loula recalls the understanding of the Federal Supreme Court (STF) that there should be no division of vacancies according to specialization in higher education exams. The prosecutor’s manifesto was for Lorena to be appointed in one of the FMB’s proven unoccupied vacancies.
